A lawsuit has been filed in the Circuit Court of Fairfax County against the employer of a local orthopedic surgeon and surgical center after a tourniquet was left on child?s wrist after surgery and the doctor and the surgical center each point the finger at the other for the mishap.

In the lawsuit, the parents of Megan Curtis allege that C. Michael Reing, MD and the Fairfax Surgical Center, negligently left a tourniquet on one of Megan?s wrists following surgery to release tendons on both thumbs. The lawsuit alleges that both defendants have blamed the other for the mishap. As a result of the error, Megan Curtis?s parents allege that she suffered pain, disfigurement and scarring on the wrist.

Megan?s mother, Lisa Curtis said ?We were shocked to find that the tourniquet was not removed after the surgery, especially after we complained about Megan?s pain. We were even more shocked to later find that everyone involved just wanted to point the finger at someone else. They forced us to hire an attorney to find out what really happened.?

Benjamin W. Glass, III, attorney for the Curtis family said: ?Doctors and hospitals want increasing immunity and other protections from malpractice lawsuits in Virginia yet when obvious negligence occurs, they play games and force people to hire lawyers. Doctors and hospitals want lots of legal protection yet when obvious malpractice occurs they often refuse to accept responsibility. The public is usually astonished to see what really goes on behind the scenes of a medical malpractice lawsuit.?

The lawsuit seeks $25,000 in damages. No trial date has been set. The case is Megan Curtis, a minor, by and through her parents Lee Curtis and Lisa Curtis v. Fairfax Surgical Center and Pediatric Orthopedic and Scoliosis Associates. Civil Action CL2006-2831.
