Pakachoag Acres Day Care Center, Inc. is pleased to announce that following protracted negotiations and mediation it has entered into an agreement with the Commonwealth of Massachusetts and the Department of Early Education and Care (EEC) to end a lawsuit pending in Suffolk County Superior Court, Civil Action No. 04-1988H.

The quality of childcare provided by Pakachoag Acres was never called into question by the lawsuit and the agreement specifies that the nonprofit will continue to provide quality childcare services to its clients. The lawsuit concerned Pakachoag Acres’ financial reports for fiscal years 1996 through 2004. None of the allegations made by the Commonwealth suggested quality of care was compromised for financial gain.

Pakachoag Acres has entered into the agreement to avoid the expense, inconvenience and uncertainty of litigation and to resolve the issues raised in the lawsuit. There has been no admission or finding of liability by or against any party. Pakachoag Acres entered into negotiations and mediation with the Commonwealth to end the distraction of the lawsuit and to focus on its primary mission of providing high quality affordable childcare to the families of Worcester County.

Independent outside public accountants certified and licensed by the Commonwealth audited and assisted in the preparation of the financial reports during the years in question. Under the terms of the agreement, Pakachoag Acres will discontinue its use of a public accountant who audited and assisted in the preparation of financial reports.

Additionally, under the agreement, Pakachoag Acres will provide the Commonwealth certain monies when the funds become available from the proceeds of the sale of real estate owned by Pakachoag Acres in Grafton and Pakachoag Acres agrees to provide EEC childcare at reduced rates in the upcoming fiscal years 2007, 2008 and 2009.

A Worcester-based nonprofit with childcare centers in Auburn, Millbury and Charlton, Pakachoag Acres provides contracted and voucher-based services under contracts with EEC including income eligible childcare for infants and toddlers, preschool and school-age children and supportive services to children with Department of Social Services involvement.
